2. Introduction

These Terms and Conditions regulate the sale, including registration, of Barvi products, through the online store www.barvi.pt . The website is managed by the company Barvi-Victor Hugo Pereira de Oliveira, NIF 241 309 395.

3. Barvi products

Barvi is an online store specializing in the sale of food and sports supplements. Our products are carefully selected to ensure quality and effectiveness. The website www.barvi.pt is available 24 (twenty-four) hours a day, 7 (seven) days a week, for all Customers interested in purchasing Barvi products. Barvi reserves the right to modify, at any time, the information, product offering, prices, promotions and commercial conditions presented in the online store www.barvi.pt.

4. Registrations in the Barvi online store

Registration is optional to place an order. Customers can fill out the form available at www.barvi.pt . Registered customers are subject to these Terms and Conditions.

5. Placing orders on the website

To order at www.barvi.pt , customers must have an email account and allow cookies and pop-ups in their browser. Customers can add products to the cart, register personal data and confirm the order. After registration, customers receive a confirmation email with the order details.

Barvi reserves the right not to accept and cancel orders already confirmed in any of the following situations:

  1. The product is unavailable;
  2. Payment is not made using any of the payment options available in the online store www.barvi.pt ;
  3. Payment is not confirmed;
  4. The billing information is not correct or verifiable;
  5. There is an error in the price quote;
  6. It is not possible to deliver to the address provided by the Customer.

6. Prices

Prices displayed include VAT. Prices are in euros (€) and are subject to change without prior notice. If there is an error in the price of the products ordered, Barvi or the Customer may cancel the order up until the order is dispatched. The total price specified at checkout includes taxes from the country of origin (Portugal) and shipping costs.

7. Payment methods

Customers can pay by Multibanco Reference (ATM), MBWAY, Bank Transfer, Paypal or Credit Card. Other payment methods are not accepted.

8. Delivery

Delivery is made from Monday to Friday, from 8am to 7pm, excluding public holidays. Delivery times in mainland Portugal vary from 1 (one) to 5 (five) business days. For the islands of Madeira and the Azores, delivery times vary from 1 (one) to 15 (fifteen) business days. In turn, for mainland Spain, delivery times vary from 3 (three) to 7 (seven) business days. Barvi's ability to respond within the aforementioned timeframes varies according to stock availability, promotional periods and Christmas. Barvi will inform the Customer of the unavailability of the product(s) ordered, and will refund the amount paid, within a maximum period of 15 (fifteen) days from becoming aware of the unavailability.

Our delivery service does not include a scheduling option, so the order will be delivered without prior contact from the carrier, and it is necessary to ensure that someone is at the delivery address.

The customer must inspect the packaging upon delivery and report any damage. Delivery is deemed to have been made upon signature on the delivery receipt at the agreed address.

If you do not receive your order within a maximum period of 45 (forty-five) days from the date of payment for the order, please send an email to info@barvi.pt informing us of the incident. After this period, Barvi cannot be held responsible for the loss of the order.

Delivery Costs:

Mainland Portugal: free shipping from €29.99. Below this amount, shipping costs will take into account the weight/volume of the goods, starting at €4.50.

Madeira/Azores Islands: postage from €29.99.

Mainland Spain: free shipping from €59.99. Below this amount, shipping costs will take into account the weight/volume of the goods, starting at €6.49.

9. Cancellations, exchanges and returns

Customers may cancel an order before shipping, provided they request it via email to info@barvi.pt . If the order has been received before shipping, we will refund the amounts paid by the Customer as stated in the order within a maximum period of 15 (fifteen) days.

If Barvi is notified via email (info@barvi.pt) and with the presentation of photographs, within 7 (seven) days, and it is confirmed that an error has occurred in the product(s) shipped or that defective product(s) have been shipped, Barvi will bear the costs of returning the product(s) in question by collecting it from the delivery address. To this end, a member of Barvi's Customer Service team from the returns and refunds department will contact the customer to schedule the collection and to provide any additional information on this matter.

Returns for other reasons are accepted within 15 (fifteen) days. Shipping costs are the responsibility of the customer to the Barvi address: Avenida Sacadura Cabral 1116, 4410-463 Arcozelo, Vila Nova de Gaia. The return of incomplete, damaged or scratched products, as well as products without the original packaging and/or label, or products with evidence of having been used, will not be accepted. If any of the conditions set out above are not met, the customer will lose the right to a refund, in which case they will have 10 (ten) days to collect the item(s) in question from the facilities indicated above, bearing the costs of the respective collection. Collection must be carried out by a freight forwarder hired by the customer, since it is not possible for individuals to collect the order in person, even if it is the customer themselves.

Exchanges are not accepted, and the customer must return the item(s), request a refund and make a new purchase.

10. Quality

Barvi sells food and sports supplements with detailed information available at www.barvi.pt .

11. Complaints

Complaints will be processed within 5 (five) working days via email to Info@barvi.pt .

12. Exclusion and limitation of liability

Barvi does not guarantee the uninterrupted operation of the website www.barvi.pt, or any of its features, and it may be suspended to carry out maintenance, repair or updates.

Barvi shall not assume any liability for any damages arising directly or indirectly from force majeure situations that prevent Barvi, in any way, from fulfilling its obligations, namely, strikes, failures in the electricity grid, telecommunications services or any other services, fires, floods, inability to obtain products, materials or services, breakdowns, delays by suppliers or carriers and changes in legislation or administrative regulations.

Barvi is not responsible for any abusive use of the User's access data to the website by third parties, as they are personal and non-transferable.

Computer records, kept by Barvi under secure conditions, are considered as proof of communications, orders and payments made between Barvi and the Customer.

13. Modification of Terms & Conditions

The Terms and Conditions may be changed at any time and users will be notified via the website.

14. Processing of Personal Data

15. Applicable Law

These Terms and Conditions are governed by Portuguese law.

16. Electronic Complaints Book

Customers can submit complaints through the Electronic Complaints Book.
